Hey folks, I'm a 2nd year apprentice trying to wrap my head around this insurance BS for HVAC jobs. We had a Trane XR17 unit in a customer's attic go down last month, compressor totally fried from what looked like low refrigerant and poor superheat management. Filed the claim with our GL policy, but they denied it saying it was 'maintenance negligence' even though we documented everything with gauges and pics. Been in the Houston suburbs my whole apprenticeship, and these hot, humid jobs are killer on equipment, zone 2 stuff you know. Anyone dealt with similar denials on compressor failures? How do you word your service agreements to cover this crap better? Saw a post on r/HVAC about pushing back on insurers, but need real tips. Edit: talked to the boss, might need to add a specific rider for equipment damage.
add a clause in your service agreement specifying that equipment failures from low refrigerant or improper superheat aren't considered negligence if you documented the initial charge with gauges. i've seen that push back insurers on similar trane claims in humid setups, just make sure to include pics as proof.

insurance denying claims cuz of 'negligence' is like blaming the compressor for not handling texas humidity, next they'll say it shoulda installed its own dehumidifier 😂

dont file claims on compressor burnouts without a full acid test and filter drier install first, i saw a guy get sued for incomplete cleanup and the insurance bailed completely.

insurance companies are total scum, always looking for any BS excuse like 'maintenance negligence' to screw us on claims while they pocket the premiums and leave us holding the bag.

screw the insurers' 'negligence' BS, if you documented superheat and gauges like you said, tell em to shove it and get a lawyer who eats these claims for breakfast cuz in humid hell like houston, low refrigerant burnouts are straight up wear and tear, not your fault.
