So I'm up in north Jersey, just wrapped a full interior repaint using Benjamin Moore Advance on this McMansion in Montclair, and the client trips over my drop cloth on the way out, sues for 'pain and suffering' after hitting her head on a Sherwin-Williams 5-gallon bucket I left propped nearby. Total claim $8k, even though my insurance covered the medical but now premiums are spiking 30%. We're in a state where every homeowner thinks they're a lawyer, and this crap happens more than you'd think in our biz. Saw a similar rant in the Painting Contractors Facebook group last month, guy got dinged for a ladder slip. FML, but hey, at least it wasn't worse. Anyone else dealt with this BS?

Insurance companies are screwing us painters on these claims, jacking rates after every little slip and fall like it's our fault clients can't watch their step.

Yeah, it's collective theft. They bank on us not shopping around.

And then they deny coverage for 'negligent placement' of basic gear like buckets.

What was the exact injury? Like, did she need stitches or just a headache?

Mine had a cat knock over a paint tray, client blamed me for $2k in carpet cleaning. Cried laughing when the judge tossed it.

Same here, north Jersey clients are the worst for this drama. Had one sue over 'fumes' causing a migraine.

yep, dropped a roller and it rolled underfoot, client twisted ankle. Insurance ate it but premiums doubled.

Switch to a policy with better liability riders for painters, I use one from Hiscox that covers tool-related slips for under $1k/year base.

Hiscox is solid, but check the exclusions for drop cloths - mine got me last year.

Yeah, added a rider for $200 more, saved my ass on a $5k claim.

Had a claim where the wife said my primer made her allergic, turned out she was just allergic to her own dust bunnies. Hilarious in court.

Lol, mine was a kid drawing on fresh walls with my brushes. Parents tried to pin $3k on me.

Court threw it out, but the lawyer fees still stung.

Document every step with photos, timestamps the setup and warnings posted. Saved me twice.

Use contract clauses that limit liability to the job cost, caps it at $5k max for interiors.

I'm so over these frivolous suits, painting ain't worth the legal headaches anymore.

Rates up 25% here too, clients think we're ATMs after every oops.

Had a $10k claim for 'emotional distress' from paint smell, judge laughed it off but process was hell.

Emotional distress? That's new level BS. Did they win?

Feel that, brother. My last one was a slip on wet paint, insurance covered but I lost a week prepping docs.

Add a $1M umbrella policy on top, costs $300/year but covers the gaps in painter-specific claims.

PE firms buying up insurers just to hike our rates, it's a racket against small ops like us.

These claims are killing solo painters, one bad one and you're done.

Yeah, had to eat $4k out of pocket last year on a denied claim.

Proud I went with a local broker who shops multiple carriers, kept my premium flat after a $6k slip claim.

Homeowners in dense areas like Jersey file claims just to get freebies.

Frustrated as hell, spent $2k on legal just to fight a $7k claim that was total fabrication.

How do you guys handle the initial client consult to weed out the litigious types?
